Personal Data – means information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name and surname, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

In connection with the User's use of the Website, the Controller collects personal data to the extent necessary to provide the various services offered, as well as information about the User's activity.

 

Personal data of all persons using the Website (including IP address or other identifiers and information collected through cookies or other similar technologies) are processed by the Controller:

  1. for the purpose of providing electronic services in terms of providing Users with content collected on the Website, providing contact forms – in which case the legal basis for processing is the necessity of processing for the performance of a contract (Art. 6(1)(b) of the GDPR);
  2. for analytical and statistical purposes – in which case the legal basis for processing is the legitimate interest of the Controller (Art. 6(1)(f) of the GDPR) consisting in conducting analyses of Users' activity, as well as their preferences in order to improve the functionalities used and services provided;
  3. for the purpose of potentially establishing and pursuing claims or defending against them – the legal basis for processing is the legitimate interest of the Controller (Art. 6(1)(f) of the GDPR) consisting in the protection of its rights;

 

User activity on the Website, including their personal data, is recorded in system logs (a special computer program used to store a chronological record containing information about events and actions concerning the information system used to provide services by the Controller). Information collected in the logs is processed in connection with the provision of services. The Controller also processes it for technical purposes; in particular, data may be temporarily stored and processed to ensure the security and proper functioning of information systems, e.g., in connection with performing backups, testing changes in information systems, detecting irregularities, or protecting against abuse and attacks.

 

The Controller provides the possibility of contacting them using an electronic contact form. Using the form requires providing personal data necessary to contact the User and answer the inquiry. The User may also provide other data to facilitate contact or the handling of the inquiry. Providing data marked as mandatory is required in order to accept and handle the inquiry, and failure to provide it results in the inability to handle the inquiry. Providing other data is voluntary.

 

Personal data provided via the contact form is processed for the purpose of identifying the sender and handling their inquiry sent via the provided form – the legal basis for processing is the necessity of processing for the performance of the service contract (Art. 6(1)(b) of the GDPR);

 

In some cases, the Controller uses profiling. This means that thanks to automatic data processing, the Controller evaluates selected factors concerning natural persons in order to analyze their behavior or create a forecast for the future.

 

Cookies are small text files installed on the device of the User browsing the Website. Cookies collect information that facilitates the use of the Website – e.g., by remembering the User's visits and the actions they perform.

 

The Controller uses so-called service cookies primarily to provide the User with services provided electronically and to improve the quality of these services. In connection with this, the Controller and other entities providing analytical and statistical services to the Controller use cookies, storing information or obtaining access to information already stored in the User's telecommunications terminal equipment (computer, phone, tablet, etc.). Cookies used for this purpose include:

  1. "strictly necessary" cookies, enabling the use of services available within the website, e.g., authentication cookies used for services requiring authentication within the website;
  2. security cookies, e.g., used to detect abuses in the field of authentication within the website;
  3. "performance" cookies, enabling the collection of information on how the website pages are used;
  4. "functional" cookies, enabling "remembering" the settings selected by the user and personalization of the user interface, e.g., in terms of the selected language or region from which the user comes, font size, website appearance, etc.;

 

The period of data processing by the Controller depends on the type of service provided and the purpose of processing. As a rule, data are processed for the duration of the service provision, until the withdrawal of consent or filing an effective objection to data processing in cases where the legal basis for data processing is the legitimate interest of the Controller. The data processing period may be extended if the processing is necessary to establish and pursue potential claims or defend against them, and after that time only if and to the extent required by law. After the end of the processing period, the data are irreversibly deleted or anonymized.

 

The User has the following rights:

  1. the right to access their personal data,
  2. the right to request rectification of their personal data,
  3. the right to request erasure or restriction of processing of their personal data,
  4. the right to object to the processing of their personal data and the right to data portability,
  5. the right to lodge a complaint – in the event of considering that the processing of personal data violates the provisions of the GDPR or other regulations regarding the protection of personal data, the data subject may lodge a complaint with the President of the Personal Data Protection Office (UODO).

The Controller has appointed a Data Protection Officer.

 

The Controller conducts risk analysis on an ongoing basis to ensure that personal data is processed by them in a secure manner – ensuring primarily that only authorized persons have access to the data and only to the extent that is necessary due to the tasks they perform. The Controller ensures that all operations on personal data are recorded and performed only by authorized employees and associates.
